Clarifications and Reconsiderations

When businesses encounter issues that are not clearly addressed by the existing legislation and guidance, it is possible to request a clarification from the FTA. This is effectively a private ruling granted to the businesses.

We assist businesses requiring clarification by:

  • Reviewing the background to the issue to be clarified
  • Helping the client to assess the potential technical positions, based on the legislation and guidance
  • Drafting the VAT clarification to be submitted to Federal Tax Authority (FTA).

We also help businesses to file appeals through the reconsideration process or seek waiver of penalties levied. This process allows taxpayers to ask the FTA to reconsider decisions taken in connection to the taxpayers' VAT affairs, including assessments for errors and the levy of penalties.

We assist businesses requiring a reconsideration/ waiver by:

  • Understanding the reason and the facts for FTA levying penalties.
  • Drafting the reconsideration/ waiver application and letter which will be submitted to the FTA.
